A maintenance contract, as regulated by Romanian law, is an agreement where one party, referred to as the maintenance provider, commits to supporting another party, known as the maintenance beneficiary, for a specified period, typically for the beneficiary's lifetime, in exchange for the transfer of property or other financial benefits.

  • In the version available on the website, this maintenance contract template includes:


    • The transfer of a real estate property in exchange for maintenance obligations (this is a maintenance contract with a valuable consideration).

    • Maintenance obligations are valid for the lifetime of the Beneficiary. 

    • Ownership of the agreed property is transferred upon the Beneficiary's death.

    • During the execution of the contract, the Beneficiary retains the right to use the property that will be transferred to the Provider. However, their right of disposition (e.g., to sell or mortgage it) is restricted, and they have explicit obligations for its preservation.

    IMPORTANT! Once the form of the maintenance contract is finalized, it must be authenticated by a public notary. The maintenance contract is valid in Romania only after completing the notarial formalities; otherwise, it is considered absolutely null and void.
